Consultation on the post implementation review of The Materials and Articles in Contact with Food (England) Regulations 2012

This report seeks to establish whether the objectives of the 2012 Regulations were achieved and currently remain relevant. It also looks at whether there have been any unintended effects on stakeholders resulting from the implementation of the 2012 Regulations and similarly on consumers’ perspectives on the 2012 Regulations.

Who will the consultation be of most interest to?

  • Competent Authorities - Local Authorities (LAs) and Port Health Authorities. 
  • Food contact materials manufacturers, importers, and suppliers, in particular of food contact plastic goods.
  • Food business operators, food businesses and industry trade bodies. 

Consultation subject

A follow up review consultation from one published in 2017 on The Materials and Articles in Contact with Food (England) Regulations 2012, incorporating as it does retained and incorporated legislation on food contact materials, principally -

  • retained Regulation 1935/2004 (Framework Regulation)
  • retained Regulation 2023/2006 (Good Manufacturing Practice)
  • retained Regulation 10/2011 (Plastics Regulation)
  • retained Regulation 450/200 (on Active & Intelligent Materials)
  • retained Regulation 1895/2005 (on Epoxy Derivatives)
  • Council Directive 84/500/EEC (on Ceramics)
  • Council Directive 78/142/EEC & Commission Directive 80/766/EEC (on Vinyl Chloride Monomer)

Purpose of the consultation

To seek stakeholders’ views on the continued practicality of the Regulations, and as to whether the costs of familiarisation have markedly changed since the earlier review; whether further rationalisation would be beneficial; and as to whether enforcement could be improved.
